Quotations

All quotes are valid for a period of 30 days (unless otherwise stated on the quote). After the 30 days have passed, I reserve the right to alter or decline the quotation.

Payments

A 50% deposit is required prior to the commencement of any work. The remaining 50% is due when the website is completed, before the website goes live.

The deposit is only refundable if I have not fulfilled my obligations set out in the initial quote. If you terminate the contract after the work has started, the deposit is non-refundable as long as I am fulfilling my part of the contact (ie. No change of mind refunds once work has commenced).

All prices are quoted in Australian Dollars exclusive of GST unless otherwise stated.

Supply of writing and images

You must supply all images and copy (wording). As part of the website design I may do small image editing tasks such as making a copy of images more suited to the web to get your website loading faster.

All other copywriting and image editing tasks may require a separate quote and are not included unless expressly written in the quotation.

Approvals

All approvals must be completed within a 7 day period unless otherwise agreed. At each approval point I expect to have a reply with acceptance or a request for modifications of the website content or aesthetic changes.

Variations

After the initial design has been agreed upon, small changes may be made throughout the design process. I reserve the right to charge a set hourly rate of $80/hr for changes if they have major changes to the initial agreement.

Timeframes

Any estimates of timeframes to complete work are approximate and I cannot be held accountable for any unforeseen delays in the completion of each project. I do, however, do my best to have projects completed in a reasonable timeframe.

During the design and approval process, there are certain points where I require information and feedback. The faster this is passed on to me, the easier it is for me to proceed into the next phase of the design.

Intellectual Property

You must ensure that you have obtained any required permissions for all copy, logos, trademarks or images that you provide for your website.

You must indemnify me and hold me harmless from any claims or legal actions related to the content of your website.

Search Engine Optimisation

I do not (and cannot) guarantee any specific positioning in search engines. I can provide basic SEO help and guidance in accordance with best practice.

Subcontracting

The large majority of the work is completed in house. I do, however reserve the right to subcontract any services that I see fit to complete the job.

Non-Disclosure

I (and anyone I contract to work on your website) agree that we will not disclose any of your confidential information to a third party.

Backups

Once the website has been handed over to you, you are responsible for all backups and maintenance on your website. This is, unless you have an ongoing service contract with us, then I am responsible for performing backups when I am updating your website. Regardless of any service contracts, you should still ensure you have your own backups available. I cannot be held responsible for any loss of data or income due to scheduled maintenance or lack of backups.

 

Web Hosting Terms and Conditions

Hosting

I work with my hosting provider to get as high uptime as possible for your website. I will endeavour to notify clients of any scheduled outages that will affect their websites.

For clients using support packages, I cannot ensure full uptime while updates are being completed. However, I will do my best to keep downtime to a minimum and if there are any specific times you would prefer updates not to be performed, please contact me and I will do my best to adhere to this timeframe.

Clients who are having websites built and are using their own hosting will not have support contracts available. Once the website is completed and signed off, I will pass the admin details over to you and have no further responsibility for maintenance of your website. Ad-hoc updates are available as extra paid support if required.

Hosting Payment

Hosting contracts can be set to either monthly or annual payments, with no lock in contracts for future payments. Once hosting is paid, there are no refunds available for the term already paid. A minimum of 30 days notice is required for cancellation of a hosting contract.

Monthly hosting payments will be made one month in advance, with the first payment for the first and last month of hosting.

If hosting payments are not made prior to the expiry date, I take no responsibility for any lost data and there may be extra charges involved in the restoration of the account.

Emails

All emails are to be downloaded to the client’s computer periodically and emails will not be kept on the server for an extended period of time. The client agrees to keep their email accounts within specified quota limits.

Email addresses must never be used for inappropriate content and I reserve the right to take action if the account is found to be used for inappropriate behaviour.

I can set up email accounts to route through Google Apps for Business (setup at an additional cost if not included in the initial quote) for an additional $5 + GST per month per email address. This includes 30GB of storage and high-end spam filtering (this amount is subject to change by google). This is my recommended email setup option.

Domains

All domain registrations and renewals are to be paid in advance and non-payment may result in the disruption of service or loss of the domain. All .com.au domain registrations require the client to provide an active and related ABN.

Maintenance Terms

Maintenance

Maintenance packages are designed to help with the ongoing maintenance of your website and some minor changes. This does not include any major changes or extensive ongoing work.

Maintenance Payment

Payment can be made for a monthly or annual term. There is no minimum contract term. A minimum of 30 days notice is required for cancellation of a maintenance contract.

The hosting and maintenance package rates may change at any time with 30 days notice to the client. Any previously paid amounts will not be subject to the change until the client’s next billing period.

Extra hours required will be bill separately at a rate of $70/hr ex GST (when on a plan including support hours)

Ad-Hoc Support

Ad-Hoc support is available to all clients. This is charged in half hour blocks, at a rate of $50 ex GST for the first half hour and $40 ex GST for each half hour after that.
